While people in the US government debate over the legalisation and acceptance of online poker games, a Pennsylvania Court has ruled that gambling machines can be games of skill, not chance. The case concerns incident four years ago when officers seized two poker machines in Bucks County.

As reported by www.philly.com, on Dec. 23, Superior Court ruled that on October 15th, 2010 police officers wrongly seized the poker machines – one Jersey Hold ‘Em and a Red, White & Blue.


Non Gambling Poker Games
County judge Albert J. Cepparulo agreed with Caplan, that “the machines, following this significant modification, no longer had the randomness of electronic poker and Texas Hold ‘Em games. This opinion was backed up by the Superior Court which asked several experts to run a predominate-factor test.
Judge Paula Francisco Ott in the opinion wrote, “For any game to constitute gambling, it must be a game where pure chance predominates the winning result rather than skill,“
